We read this municipality’s code, but parts of our finding still need confirming. Treat it as a starting point and confirm with the code office.
Not the same as the Town of Avon. No ADU rule found in the Town of Avon code. See Livingston County. Check which one is on your property tax bill.
The Village of Avon allows one attached or detached ADU with up to two bedrooms, the owner on site most of the year, after site plan review.
The code has ADU standards, but we have not confirmed which permit each zoning district requires.
Whether any of this applies to your lot depends on your zoning district and your property.
The rules we found
| What the code says | Allowed; permit type not confirmed |
|---|---|
| Detached (backyard) unit | Yes, in an accessory structure that meets all accessory-structure rules; not in a nonconforming structure |
| Inside or attached | Yes, in the main house; new outside entrance on the side or rear |
| Size limit | No ADU-specific cap found; accessory-structure size, setback, coverage and height rules apply |
| Bedrooms | 2 |
| Owner must live on site | Yes. An owner lives on site at least nine months a year; rent may be collected on only one unit; notarized affidavit; new owner files within 30 days |
| How approval works | Site plan review required; whether a special use permit is also needed depends on the district (use table not checked) |
| Other rules | One ADU per single-family home. It can't be split off or sold on its own. An addition must match the house and can't be taller than it. |
Code section: §30-68 Specific regulations by use (accessory dwelling units). Section added June 1, 2020 (Local Law 2 of 2020)
What this means for your plans
- The owner has to live on the property. If you plan to move away, spend winters somewhere else or sell, read the owner rule above closely. Renting and owner rules.
What we’re still confirming
- Districts where ADUs are allowed and the permit type in each
Before you spend money on drawings
- Confirm the Village of Avon governs your lot: it should be the municipality on your property tax bill.
- Find your zoning district on the municipal zoning map; the rules above can differ by district.
- Call or write the code office with your address and what you’re picturing, and ask for the answer and the code section in writing.
- On septic or a well? Ask the Livingston County health department whether the system can serve an extra bedroom. On public sewer? Ask your sewer district.
Our guides explain the approval process, site and utility checks and what an ADU costs.
