We read this municipality’s code, but parts of our finding still need confirming. Treat it as a starting point and confirm with the code office.
Rushville’s 2026 zoning law allows one accessory dwelling on a single-family lot. The owner must live in one of the two units, and the lot needs public water and sewer. Ask the village which districts allow it and what approval it needs.
The code has ADU standards, but we have not confirmed which permit each zoning district requires.
Whether any of this applies to your lot depends on your zoning district and your property.
The rules we found

| Size limit | In-house units: house of at least 1,450 sq ft before alteration (§5.2F) |
| Bedrooms | Not applicable |
| Owner must live on site | The owner must live in one of the two units (§5.2B) |
| How approval works | Ask the village which districts allow it and what approval it needs (Table 7.1 columns unread) |
| Other rules | Separate exterior access; one extra off-street space and no new driveway; no separate sale of the accessory dwelling; municipal water and sewer required (§5.2C, D, G, H). The village sits in both Ontario and Yates counties. |
What we’re still confirming
- Which districts allow an accessory dwelling (Table 7.1 columns)
- Approval type (permit or review)
Before you spend money on drawings
- Confirm the Village of Rushville governs your lot: it should be the municipality on your property tax bill.
- Find your zoning district on the municipal zoning map; the rules above can differ by district.
- Call or write the code office with your address and what you’re picturing, and ask for the answer and the code section in writing.
- On septic or a well? Ask the NYS Department of Health’s Geneva District Office (315-789-3030) whether the system can serve an extra bedroom. On public sewer? Ask your sewer district.
Our guides explain the approval process, site and utility checks and what an ADU costs.
